The Victim Fine Surcharge
Back in 1996 when Bill c-47 was passed I said the Victim Fine Surcharge was unconstitutional. People said I was crazy, including criminal lawyers who could ask a judge to waive it. No one seemed to listen that a mandatory victim fine surcharge was a tax, unconstitutional or anything other than who cares? it’s POA court. Well, years later, in one of Harper’s unlikely laws passes, lo and behold, it’s an issue.

So maybe I’m not crazy. I’m not sure whether I should laugh or cry as I see lawyers arguing over this. Apparently it’s controversial. Who knew?
